ORDER

This writ petition has been filed for the issue of a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 15.07.2020 and to take departmental action against the fifth respondent and her husband, K.Ramabathiran @ Selvan for giving a damaged silk saree by doing malpractice thereby causing damage to the reputation of the Society. 2.It is the case of the petitioner that he is a member of the fourth respondent Society since 02.07.2004. It is his further case that the Society consists of 1825 members. The Society supplies raw materials to its members for producing silk sarees and after these sarees are woven, they purchase the same from the members after paying the weaving charges.

3.The petitioner would submit that it is only the sarees without any defect that is accepted by the Society and the society has a reputation in the market for supplying quality goods. He would submit that the fifth respondent is the member of the fourth respondent Society and that she has been a member of the Society for over 20 years. He would further submit that the fifth respondent had used her 3/6

influence to compel the authorities to accept the damaged silk sarees that are woven by her husband. He would submit that he along with other members have questioned the authorities about the acceptance of damaged sarees woven by the fifth respondent's husband.

4.It is his further case that enraged by this, the petitioner along with others had assaulted one T.K.Dhukkaram, who lived near the petitioner's house and who is also a member of the Society. He had sustained grievous injuries and the petitioner had given a complaint against the fifth respondent's husband and his allies. The petitioner would go on to state that even the police had extended helping hand to the fifth respondent and her husband. Therefore, he has come forward with the above writ petition.

5.The writ petition is not supported by any piece of evidence except a copy of the First Information Report and representation. 6.The fourth respondent has filed a counter denying the allegation of the petitioner that they had received defective goods from the fifth respondent. They 4/6

had also denied the statement that the fifth respondent had influenced the management of the Society.

7.The writ petition appears to be a motivated one and not supported by any proof. Therefore, in the light of the counter filed by the fourth respondent and the fact that the petitioner has not given any proof for the allegations made out by him, the Writ Petition is dismissed. However, there shall be no order as to costs.
