Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the third respondent to release the petitioner's vehicle Tractor and Trailer bearing registration No.TN 65-AD-6183 from his custody and to hand over the above vehicle to the petitioner forthwith, by considering the petitioner's representation dated 24.08.2020 within the time limit that may be stipulated by this Court. O R D E R

Heard the learned counsel on either side. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

2. The petitioner seeks release of the petition mentioned vehicle.

It was seized in connection with the illegal transportation of sand.

3. The learned Additional Government Pleader appearing for the respondents points out that both the petitioner as well as the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.10462 of 2020 vehicle concerned have involved in a previous case of the same nature.

4. Hence, I am not inclined to grant relief. This writ petition stands dismissed. The respondents shall however produce the petition mentioned vehicle before the jurisdictional Court without any delay. It is for the petitioner to move the jurisdictional Court for relief.

5. I make it clear that I have not gone into the merits of the matter. No costs.
