For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No. 32 of 2019 on the file of the Respondent Police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner apprehends arrest at the hands of the respondent Police for the offence under Section 420 of I.P.C.

3. The case of the prosecution is that the accused in this case had induced the victim to part with huge sums of money on the promise that they would be issued with posting orders in the High Court. The petitioner's husband is said to have posed himself as Reporter on the High Court beat. When the petitioner moved this Court on the earlier occasion, it was submitted that the petitioner's husband is still absconding. Therefore, this Court dismissed the petitioner's earlier bail petition on 21.02.2020. There is no change in circumstance. The petitioner's husband continues to abscond.

4. The petitioner's counsel would claim that Accused Nos.3 and 4 were granted anticipatory bail by the Sessions Court. But then, Accused Nos.3 and 4 happen to be the daughters and therefore, their case certainly stands on a separate footing altogether. Hence, when this Court indicated that the petitioner's case would be considered if the petitioner's husband surrenders, the petitioner's counsel states that the petitioner's husband had left her. But the petitioner has not filed any Divorce petition or matrimonial proceedings against him. Therefore, the reason projected by the petitioner's counsel does not appeal to me.
