The Criminal Original Petition has been filed to direct the respondents to initiate criminal prosecution by registering First Information Report as per the Section 83 of Indian Registration Act and Circular No.41530/U1/2017 dated 08.11.2017 issued by the first respondent.
2.According to the learned counsel for the petitioner, the father of the petitioner has created a fraudulent document in favour of the petitioner's sister on the file of the Joint SubRegistrar, Nagercoil. With regard to this, the petitioner made a
complaint before the second respondent, which is now pending. Thereafter, the petitioner made a complaint before the fifth respondent. No action is yet to be taken. Hence, the present petition has been filed.
3.The learned Government Advocate (Crl.side) appearing for the respondents submitted that the said complaint was closed, after obtaining statement from the concerned parties. A copy of the statement has also been produced before this Court. 4.It is an admitted fact that the enquiry is now pending before the District Registrar/second respondent herein for fraudulent document created by the proposed accused in favour of the daughter of the proposed accused. At this stage, the learned counsel for the petitioner seeks permission of this Court to withdraw the present criminal original petition with liberty to make a fresh complaint to the fifth respondent police, at the later stage subject to the out come of the finding of the order passed by the District Registrar/second respondent herein. 5.In the light of the above, this Criminal Original Petition is dismissed as withdrawn with liberty to the petitioner to file a fresh complaint to the fifth respondent police, if it is necessary at the later stage.
