ORDER

This Criminal Original Petition is filed to modify the condition in Crl.M.P.No.1034/2022 dated 26.04.2022 on the file of Principal District and Sessions Court, Ramanathapuram with regard to the appearance before the respondent police.

2. It is the case of the petitioner that a case has been registered against the petitioners in Crime No.03 of 2022 for the offence under Section 498(A) IPC and Section 4 of Dowry Prohibition Act based on the complaint given by one Pargana abrose. Hence, the petitioners have filed a petition for anticipatory bail in Cr.M.P.No.1034 of 2022 before the learned Principal District and Sessions Judge, Ramanathapuram. After careful consideration, the learned Principal District and Sessions Judge, Ramanthapuram has granted anticipatory bail to the petitioners on condition that the petitioners shall appear before the respondent police station daily at 10.00 a.m. until further orders. Against the said condition, the petitioner has filed this petition.

3. The learned counsel appearing for the petitioners would submit that the first petitioner is the senior citizen and aged about 60 years and she is also taking treatment for her old age ailments and the second petitioner is a cooli and driving an auto for his family basic needs. Hence, the petitioners are not able to comply with the conditions as ordered by the learned Principal District and Sessions Judge, Ramanathapuram. He further submits that there is also a life threat by the defant complainant and hence, the petitioner has filed this petition.

4. Heard the learned Government Advocate (Crl. Side) appearing for the respondent.

5. Considering the facts and circumstances of the case, this Court is inclined to modify the condition imposed against the petitioners. Accordingly, the conditions imposed against the petitioners are modified to the effect that the first petitioner is directed to appear before the respondent police as and when required for interrogation and the second petitioner is directed to appear before the respondent police monthly once i.e., on the first working day of every English calendar month until further orders.

6. With the above direction, this Criminal Original Petition is disposed of.
