PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the third respondent to release the determined compensation amount to the petitioner in respect of the land acquired in Survey Nos.1599 (4A), 1599 (4B), 1599 (5A), 1599(5B) of Moolakaraipatti Village, Nanguneri Taluk, Tirunelveli District within the time frame fixed by this Court. O R D E R

The present writ petition has been filed seeking a Mandamus as against the third respondent to release the determined compensation amount to the petitioner in respect of the land acquired in Survey Nos.1599(4A), 1599 (4B), 1599(5A), 1599(5B) of Moolakaraipatti Village, Nanguneri Taluk, Tirunelveli District.

2. According to the learned counsel appearing for the writ petitioner, the lands which were purchased by the petitioner under a Sale Deed dated 09.02.2011 had been acquired by the respondent officials and already 2/5

compensation amount has been determined. However, the compensation amount has not been released in favour of the petitioner. Hence, the present writ petition.

The learned Government Advocate appearing for the respondents relying upon the counter submitted that the writ petitioner purchased an extent of 0.30.5 out of 1.10.0 Hectares in Survey No.1599/4B and an extent of 0.56.0 out of 1.26.0 Hectares in Survey No.1559/5B under registered sale deed dated 09.02.2011. According to the respondents, these lands were not acquired for Thamirabarani-Karumeni River Linking Project. Therefore, the question of releasing the determined compensation amount in favour of the writ petitioner does not arise.

4. It is also brought to the notice of this Court that on the request made by the petitioner, an order has been passed on 17.04.2023. Without challenging the same the present writ petition has been filed.

5. In view of the above said facts it is clear that the property purchased by the petitioner has not been acquired by the respondent officials and 3/5

therefore, the issue of releasing the determined compensation in favour of the writ petitioner does not arise.

6. With the above said observation, this writ petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
