Respondents/Respondents Prayer: Civil Revision Petition is filed under Arcitle 227 of the Constitution of India, seeking a direction to the learned Rent Controller cum District Munsif, Madurai Town to expeditiously to dispose of the petition in R.C.O.P.No.191 of 2014. For Petitioner : Mr.R.Vijayakumar

ORDER

Seeking a direction to the learned Rent Controller cum District Munsif, Madurai Town to dispose the Rent Control Original petition in R.C.O.P.No.191 of 2014 as expeditiously as possible, preferably within a time which may be fixed by this Court, this Civil Revision petition is filed after invoking the provisions of Article 227 of the Constitution of India.

2.Of course, the prayer itself is a limited one. What it transpires from the affidavit filed by the revision petitioner is that he had filed the Rent Control Original petition as against the respondents under Sections 10(2)(ii)(b), 10(2)(ii)(a), 10(2) (iii), 10(2)(v) and 10(3)(a)(i) of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1860 for eviction from the petition mentioned premises.

3.The respondents had entered appearance in the above said rent control petition in the month of July 2014. However, they have not evinced any interest in filing their statement of objection even after a passing of more than a year. The above said petition stood posted on 18.12.2015 for want of statement of objection. Even on that day also the respondents never came forward to file their objection and the petition itself is being adjourned periodically unnecessarily. Under these circumstances, the petitioner has approached this Court with this revision petition.

4.Heard Mr.R.Vijayakumar, learned counsel appearing for the petitioner and perused the grounds of revision. 5.This Court after having satisfied with the reasons assigned therein, finds that to meet the ends of justice, a direction may be given to the learned Rent Controller cum District Munsif, Madurai Town as sought for by the petitioner. https://hcservices.ecourts.gov.in/hcservices/

6.Accordingly, the Civil Revision petition is allowed. The learned Rent Controller (District Munsif), Madurai Town is directed to dispose the rent control original petition in R.C.O.P.No.191 of 2014 within a period 6 months from the date of receipt of a copy of this order, after receiving the memo of objection from the opposite party.
