[Order of the Court was made by M.V.MURALIDARAN, J.] The petitioner has come up with this Writ Petition seeking to forbear the respondents from closing the Tamil Nadu Cement Factory (TANCEM), at Alankulam, Virudhunagar District or selling the same to private firms.

2.We have heard the learned counsel appearing on either side. We have also perused the records carefully.

3.Today, the Managing Director (Additional Charge), Tamil Nadu Cements Corporation Limited, Chennai, has filed a detailed counter, wherein in paragraph No.4 he has stated that there is no proposal with the Government either to close or to sell the Tamil Nadu Cements Corporation Limited, Alangulam, Virudhunagar District to private firms.

4. In view of the said statement of the respondents, nothing survives for adjudication in this petition. This Writ Petition is, therefore, dismissed. No costs.

Consequently, connected miscellaneous petition is also dismissed.
