Respondent/Respondent/ Defendant PRAYER: Petition is filed under Section 227 of Constitution of India, to call for the records and to set aside the order passed in allowing the I.A.No.218 of 2013 in O.S.No.48 of 2006, dated 11.09.2015 on the file of the Additional Subordinate Court, Dindigul, by allowing this Civil Revision Petition. O R D E R

It is represented by the learned counsel for the petitioner that the respondent has entered into an agreement to his property for consideration of Rs.3,50,000/-. The petitioner has already paid Rs.3,00,000/-. As per the compromise entered into between the parties now, the petitioner has agreed to pay an additional amount of Rs.2,00,000/- for execution of the sale deed in favour of the petitioner.

It is further submitted by the learned counsel for the petitioner that based on the decree passed in O.S.No.48 of 2006 by the Additional Subordinate Court, Dindigul, the petitioner has filed an Execution petition in E.P.No.9 of 2012 and the same is pending before the Subordinate Court, Dindigul. The petitioner is ready to pay the balance amount to get a Sale Deed before the Executing Court.

3. The learned counsel for the respondent would submit that the respondent has agreed to execute sale deed on receipt of the additional amount and the balance sale consideration.

4. In view of the above submissions, this Civil Revision Petition is disposed of, directing the petitioner to pay the balance amount of Rs.2,50,000/- to the respondent within the period of one month from the date of receipt of copy of this order and the respondent on such payment shall execute sale deed in favour of the petitioner.

5. Accordingly, the Civil Revision Petition is disposed of. Consequently, connected Miscellaneous petition is closed. No costs.
