Heard both sides.

2.The respondent had levied penalty on the petitioner for illicit quarrying. The impugned order is appealable before the Commissioner of Geology and Mining, Chennai. Interim order was granted in favour of the petitioner on condition. The petitioner has since complied with the said condition. The petitioner through his counsel states that he will file an appeal before the appellate authority within a period of four weeks from the date of receipt of a copy of this order. If the appeal is filed within the aforesaid period, the interim order earlier granted by this Court will continue till the disposal of the appeal. The appellate authority is called upon to dispose of the appeal to be filed by the petitioner as expeditiously as possible. If the petitioner fails to file the appeal within a period of four weeks from the date of receipt of a copy of this order, the benefit of this order will get automatically vacated. I make it clear that I have not gone into the merits of the matter. All the contentions of the petitioner are left open.

3.This writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
