ORDER

The defendants in O.S.No.354 of 2013 on the file of the learned Principal District Munsif, Kumbakonam are the revision petitioners herein. The said suit has been filed for permanent injunction. The case of the revision petitioners is that the suit is liable to be rejected in view of the judgment rendered in S.A.No.1114 of 2008.

2. This Court is of the view that questions of fact or mixed questions of law and fact cannot be framed as a preliminary issue. Therefore, the order impugned in this Civil Revision Petition is sustained. The defense available to the revision petitioners are left open.

3. Since this is the suit of the year 2013, the Court below is directed to dispose of the main suit itself in accordance with law and on merits, within a period of four months from the date of https://hcservices.ecourts.gov.in/hcservices/

receipt of a copy of this order.

4. With the above direction, this Civil Revision Petition stands dismissed. No Costs. Consequently, connected miscellaneous petition is dismissed.
