For Respondent : Mr.B.Nambi Selvan, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.331/2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who apprehend arrest at the hands of the respondent Police for the offence punishable under Sections 448, 395 and 397 of IPC in Crime No.331 of 2020, seeks anticipatory bail.
2. The case of the prosecution is that the defacto complainant is having two houses and he wanted to sell a house, for that, he informed the same to Land broker namely Selvam. On 17.09.2020, the above said Selvam brought six unknown persons to visit his house. Thereafter, on 19.09.2020, when the defacto complainant was talking with his relatives, the aboe said six persons trespassed into his house and tie his hand in a chair and took away M1 Cellphone, gold chain from his neck along with Redmi Cellphone, SBI ATM Card, Driving License, Aadhar Card, Pan Card and a sum of Rs.3,000/-. Hence, the present case has been registered.

3.The learned counsel for the petitioners submitted that the petitioner is an innocent person and he has been falsely implicated in this case.
4.The learned Additional Public Prosecutor appearing for the respondent police strongly objected for grant of anticipatory bail to the petitioner by stating that the investigation is at preliminary stage and the petitioner is having four previous cases, which are similar in nature.
5.Considering the facts and circumstances of the case, the seriousness of allegation levelled against the petitioner and the fact that the petitioner is having four previous cases, which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioners.
