PRAYER :- For anticipatory bail in Crime No.152/2020 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 8(C) and 20(b)(ii)(B) of NDPS Act in Crime No.152 of 2020, seeks anticipatory bail.
2. The case of the prosecution is that on 22.02.2020 at about 6.00pm., the defacto complainant being the police was patrolling the area near Neeravimeadu Oorani. On seeing the police, the petitioner/accused fled away from the place putting the bag down. A2 was arrested by the police and upon search, it was found that 1.300kgs of Ganja was in possession of accused persons and the same was seized. Hence, the case.
3. Heard the learned counsel on either side and perused the materials available on record including the First Information Report.

4. It is seen that the petitioner was already granted anticipatory bail by this Court in Crl.O.P(MD).No.3474 of 2020 on 26.02.2020. However, the petitioner failed to surrender before the concerned Magistrate Court and also failed to execute any sureties. Though the respondent completed the investigation and filed a final report, the petitioner again involved similar type of eight cases. That apart, the petitioner was found in possession of 1.300kgs of Ganja and it is the case of NDPS. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
