Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to modify the condition in so far as to disburse the deposited amount for medical expenses of the defacto-complainant in connection with Crl.O.P.(MD).Nos.8768 & 8807/2022 dated 11.05.2022. COMMON ORDER : These petitions coming up for orders on this day, upon perusing the petitions filed in support thereof and upon hearing the arguments of M/S.HAROON RASHEED.D.S., Advocate for the petitioner in both petitions and of M/s.M.AASHA, Government Advocate (crl.side) on behalf of the Respondents in both petitions the court made the following order:- These petitions have been filed to modify the conditions imposed by this Court in Crl.O.P.(MD)Nos.8768 & 8807 of 2022, dated 11.05.2022 insofar as to disburse the deposited amount for medical expenses of the defacto-complainant.

2. The learned counsel appearing for the petitioners submitted that as per the order of this Court, the petitioners have deposited the amount before the concerned Court and enlarged on bail. He further submits that if the petitioners succeeded their case on trial, the amount may be refunded. Hence, the petitioners have filed these modification petitions.

3. The learned counsel appearing for the intervenor would submit that after getting consent from the petitioners, the conditional orders have been passed and hence, he opposed this petitions.

4. Considering the facts and circumstances of the case and also considering the fact that the petitioners have complied with the conditions and therefore, the contention made by the petitioners as such is not maintainable. Hence, this Court is not inclined to modify the condition imposed by this Court in Crl.O.P.(MD)Nos.8768 & 8807 of 2022, dated 11.05.2022.
