Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the third respondent to consider the petitioner as eligible candidate, for the post of Road Inspector Grade-II. For Petitioner : Mr.K.Anandan For Respondents : Mr.K.Mu.Muthu, Additional Government Pleader.

ORDER

The relief sought for in the present Writ Petition is for a direction to direct the third respondent to consider the petitioner as eligible candidate, for the post of Road Inspector Grade-II. 2.The very relief sought for in the present Writ Petition cannot be considered at this length of time. The process of selection undertook by the respondents during the year 2015, had already been concluded and the selected persons were appointed. The Court cannot declare whether the candidate is eligible for appointment or not. Such decisions are to be taken by the competent authority, only after verifying the qualifications as well as criteria fixed in the rules in force. Thus, the prayer sought for is innocuous and cannot be considered for the purpose of issuing a direction to consider the writ petitioner as eligible candidate for appointment to the post of Road Inspector Grade-II. https://hcservices.ecourts.gov.in/hcservices/

3.However, the respondents at the time of undertaking the process of selection, if any application is filed by the writ petitioner, is bound to consider the qualification, criteria and other particulars with reference to the rules in force and accordingly, take a decision whether the writ petitioner is qualified for appointment or not. Such an exercise shall be done, if any notification is issued by the respondents for selection and appointment and in the event of receipt of any application from the writ petitioner.

4.This being the procedures to be followed, the relief as such sought for in the present Writ Petition cannot be granted. Accordingly, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
