PRAYER :- For Bail in Crime No.52 of 2023 on the file of the Respondent Police ORDER : The Court made the following order :- The petitioner/A7 who was arrested and remanded to judicial custody on 01.03.2023 for the offence punishable under Sections 147,294(b),323, 324, 307, 506(ii) @ 302 of IPC in crime No.52 of 2023 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that there was a group clash between two groups in which five persons sustained injuries and one person died, hence the case.
3. Heard both sides and perused the materials available on record including the First Information Report.
4. There are totally eight accused in this case and the petitioner herein is arrayed as A7. There is specific overt act as against the petitioner herein. Further in the group clash one person died and five persons sustained injuries. That apart proposal has https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.7717 of 2023 been sent to detain the petitioner under Act.14 of 1982. Further there is no change in circumstances of the case to consider the present bail petition even after dismissal of the earlier petition, hence this Court is not inclined to grant bail to the petitioner.
