ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the Refusal Number: RFL / Kariyapatti / 12 / 2025, dated 14.02.2025 and consequently, to direct the respondent to register the sale deed dated 12.02.2025 presented by the petitioner's vendor for registration. 1/4
2.In the refusal slip, the respondent has stated that the said plot is an unapproved layout.
3.On perusing the schedule of properties in the sale deed, it is seen that the petitioner is purchasing 5 cents of land and already there is an existing common pathway on the eastern side of the property. Therefore, it is not a newly layouted property. Further, in the year 2019, the same property was sold and it was registered by the Registration Department. Therefore, the present sale deed with come under exemption clause under Section 22 A. 4.Therefore, the impugned refusal is incorrect and the same is quashed. The respondent is directed to register the property within a period of four weeks from the date of receipt of a copy of this order. 5.With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
