For Respondent : Mr.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime no. 500 of 2021 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/sole accused, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 379 of IPC in Crime No.500 of 2021, seeks anticipatory bail.
2. The case of the prosecution is that on 10.06.2021, the defacto complainant who is the Assistant Director in Geology and Mining Department along with other officials were engaged in preventing offences relating to Mines and Minerals they found a tipper lorry bearing Reg. No.TN 34 Q 5281 near Major mines quarry with 10tons of limestone. On enquiry it is revealed that the said limestone was stolen from the quarry with an intention to sell. The petitioner also used Hyundai Hitachi Iton machine for removing limestone. Hence, the complaint.

CRL OP(MD). No.8502 of 2021 3.The learned counsel for the petitioner would submit that the petitioner is innocent and she has been falsely implicated in this case. He would also submit that she had no knowledge of using the vehicle in the commission of offence.
4.The learned Government Advocate(Crl.Side) opposed the petition on the ground that the investigation is at the preliminary stage and some of the accused persons are still absconding.
5. This is the case where the accused persons said to have stolen 10tons of limestone from the Majormines quarry . Some of the accused are still absconding. This case was registered only on 10.06.2021 and the investigation is at the nascent stage, hence this Court is not inclined to grant anticipatory bail to the petitioner.
