O R D E R

This petition has been filed by the petitioner to direct the respondent no.2 not to harass the petitioner by entering into the civil disputes.

2. According to the petitioner, there is a civil dispute pending between the petitioner and the 3rd respondent and therefore, the 3rd respondent lodged a false complaint before the 2nd respondent and based on the same, a case in Crime No.52 of 2025 has been registered and a civil suit is also pending in O.S.No.111 of 2025 on the file of the learned IInd Additional District Judge, Trichy. While so, the 2nd respondent taking advantage of the complaint lodged by the 3rd respondent has insisted the petitioner to hand over the possession of the property. Therefore, he sent a representation dated 13.02.2025, but the same has not been considered. Hence this petition.

3. The learned Additional Public Prosecutor (Criminal Side) appearing for the respondents no.1 and 2 would submit that based on the complaint lodged by the 3rd respondent, they registered a case in Crime No.52 of 2025 and they have not interfered with the civil dispute and they Page No. 2 of 4

never insisted the petitioner to hand over the possession to the 3rd respondent. Therefore, the petition is liable to be dismissed.

4. Considering the prayer sought for in the petition, this Court even without issuing notice to the 3rd respondent inclined to pass orders in this petition.

5. According to the petitioner, the 2nd respondent harassed the petitioner by interfering with the civil dispute and the 2nd respondent stoutly denied the alleged interference and only for investigation purpose in Crime No.52 of 2025, they called the petitioner. Therefore, recording the above said submission of the learned Additional Public Prosecutor that the 2nd respondent police have not harassed the petitioner, this Criminal Original Petition is closed.
