PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, 2023, to issue a direction to the learned Judicial Magistrate No.II, Sivagangai, to dispose of C.C.No.177 of 2019 on the file of the learned Judicial Magistrate No.II, Sivagangai, as expeditiously as possible, preferably within a time bound period as may be fixed by this Court.

ORDER

The first accused in C.C.No.177 of 2019 on the file of the learned Judicial Magistrate No.II, Sivagangai, has filed the present petition seeking expeditious disposal of the criminal case.

2. A perusal of the records reveal that out of 21 witnesses, 4 of them have been examined and for examination of the other witnesses, it is posted on 24.04.2026.

3. According to the learned Counsel appearing for the petitioner, the F.I.R. was registered on 30.03.2017 and a charge sheet was laid in the year 2018 and it was taken on file in the year 2019 and for the past 7 years, the trial is proceeding in a very slow pace.

4. Considering the above said facts, there shall be a direction to the learned Judicial Magistrate No.II, Sivagangai, to expeditiously dispose of C.C. No.177 of 2019 on or before 31.08.2026.

5. With the above said observations, this Criminal Original Petition stands disposed of.
