Respondents Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus directing the respondent No1 to grant parole for the period of 20 days to the petitioner's husband namely Siddique Ali @ Sulthan who is convicted in one murder case and languishing in Palayamkottai Central Jail for the period of 23 years by considering the petitioner's representation dated 21.02.2023.

ORDER

[Order of the Court was made by R.SURESH KUMAR, J.] The writ petition has been filed for a direction to the respondent No1 to grant parole for a period of 20 days to the petitioner's husband namely Siddique Ali @ Sulthan who is convicted in one murder case and languishing in Palayamkottai Central Jail for the period of 23 years by considering the petitioner's representation dated 21.02.2023.

2. Today, when this petition is taken up for hearing, the learned Additional Public Prosecutor would submit that the said request of the petitioner for grant of ordinary parole to her husband, having been considered, was rejected by the first respondent, by his proceedings in No. 534/cj.2/2023 dated 23.04.2023 and in support of his contention, he has also produced the copy of the said proceedings.

3. Since the request of the petitioner having been considered was rejected by the competent authority by his proceedings dated 23.04.2023 and the order also has been produced before this Court and a copy of the same has also been served on the learned counsel for the petitioner, the learned counsel wants to challenge the said order.

4. Recording the same, this writ petition is dismissed with the above said liberty to the petitioner.
