ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) Challenge has been made to the order of the writ Court dated 17.12.2024 in W.P.(MD)No.28125 of 2024, in and by which the the order dated 23.10.2024 and 12.11.2024 were set aside with a direction to restore the death certificate of the petitioner's father by mentioning the petitioner's grand-father name as Mohamed Kasim Ambalam and issue a fresh certificate to the petitioner's father. 2.The writ petition has been filed with an allegation that the father of the petitioner died on 21.08.1991 and his death has been registered with the Municipal Authorities. However, at time of issuing death certificate, the petitioner's grandfather name has been wrongly mentioned as if 'Kasim Ambalam' instead of 'Mohamed Kasim Ambalam'. 2/5

Therefore, the petitioner made an application before the fourth respondent seeking correction in the death certificate and the fourth respondent has made correction in the death certificate and issued a fresh death certificate on 14.09.2021. However, the same has been objected by the fifth respondent. Based on such objection, the second respondent has cancelled the certificate dated 14.09.2021. Challenging the same the petitioner has filed the writ petition.

3.The Writ Court found that the original entry dated 01.09.1991 recorded the name of the petitioner's grandfather, and no corrections had been made to this entry. However, on application the fourth respondent has issued a fresh death certificate on 14.09.2021. However, the second respondent has wrongly cancelled the death certificate that had been issued to the petitioner's father. This discrepancy was revealed during the enquiry. The Court further observed that such an error appears to have occurred in connivance with certain officials.

4.Taking note of the above facts, the Writ Court held that the name of the petitioner's grandfather had been inserted only in the later 3/5

certificate issued by the officials and allowed the writ petition directing the authorities to issue the death certificate reflecting the original name of the petitioner's grandfather as 'Mohamed Kasim Ambalam'. 5.We find no reason to interfere with the order of the learned Single Judge. Accordingly, the writ appeal stands dismissed. Consequently, the connected miscellaneous petition is closed. There shall be no order as to costs.
