Heard the learned counsel on either side.

2. The petitioner wants the sale deed executed in favour of Rahmatullah to be cancelled. In the very nature of things, the said Rahmatullah must be heard before any final order is passed by the second respondent. Even though the said Rahmatullah is not impleaded before me, his Counsel appeared before this Court and made a submission that his vendor Haja Bakrudeen should also be heard. I find merit in the said contention. I, therefore, direct the second respondent to conduct enquiry after putting the aforesaid two persons on notice. I make it clear that I have not gone into the merits of the matter. It is open to the second respondent to pass order one way or the other. Such final order will be passed within a period of three months from the date of receipt of a copy of this order.
