This Criminal Miscellaneous Petition filed under Section 432 of B.N.S.S. praying to exempt the petitioner from surrendering in the Trial Court in pursuance of the conviction and sentence imposed on the petitioner by the learned JM, Bodinayakkanur, Theni District made in S.T.C.No.2148 of 2019 dated 16.03.2023 as confirmed subsequently by the learned Additional District and Sessions Judge, (FTC), Theni made in C.A.No.62 of 2023, dated 23.10.2023 pending disposal of the above revision.
ORDER
This Criminal Miscellaneous Petition has been filed to exempt the petitioner from surrendering in the Trial Court in pursuance of the conviction and sentence 1/3
imposed on the petitioner by the learned JM, Bodinayakkanur, Theni District made in S.T.C.No.2148 of 2019 dated 16.03.2023 as confirmed subsequently by the learned Additional District and Sessions Judge, (FTC), Theni made in C.A.No.62 of 2023, dated 23.10.2023 pending disposal of the above revision.
2. The learned counsel for the petitioner seeks permission of this Court to withdraw this petition and has also made an endorsement to that effect.
3. Recording the same, this Criminal Miscellaneous Petition is dismissed as withdrawn.
