ORDER

(Order of the Court was made by the DR.G.JAYACHANDRAN.,J.) This matter is relating to the disciplinary proceedings against the delinquent in connection with missing of Court records and fabrication of the signature of the Presiding Officer. Earlier, this Court has directed the Principal District Judge to take all endeavour for tracing the records within time prescribed. Despite extension of time on few occasions, the Judicial Magistrate, Lalgudi, Trichy District had reported that sincere search of missing records did not yield any result till date and sought permission of this Court to resume the departmental enquiry.

2.On considering the nature of the misconduct, we are of the view that the Writ petition which was disposed of on 24.04.2025 directing the second respondent namely, the Judicial Magistrate, Lalgudi, Trichy District to finalise the charge memo and pass appropriate orders within two months from the date of receipt of the order copy and the time has been periodically extended in view of the non-availability of the missing records. As to reach a logical end, the matter cannot be kept pending for want of missing records. Therefore, we direct the second respondent/The Judicial Magistrate, Lalgudi, Trichy District to resume the enquiry on the disciplinary proceedings completed as expeditiously as possible, within a reasonable time.
