This Petition is filed under Section 430(1) of BNSS praying to suspend the sentence imposed against the petitioner in S.C.No.27 of 2017 dated 21.04.2023 on the file of the learned Sessions Judge, Fast Track Mahila Court, Sivagangai and enlarge him on bail pending disposal of the above appeal. 1/3

ORDER

When the matter is taken up for hearing today, the learned counsel appearing for the petitioner submitted that this Court by order dated 23.04.2025 had granted interim bail to the petitioner on medical grounds. It is further submitted that the petitioner has been now referred to Government Rajaji Hospital for further treatment and that he is going to file time extension petition.

2. The learned Additional Public Prosecutor appearing for the respondent submitted that the petitioner has not surrendered after the expiry of interim bail already granted.

3. As no extension petition has been filed sofar, it is up to the respondent to arrest the accused.
