ORDER

The petitioner is the sole accused in Spl.C.C.No.20 of 2022 and he was found guilty and convicted and sentenced by the Mahila Court, Thoothukudi, by Judgment dated 28.10.2024.

2. This Court, while suspending the sentence imposed by the trial Court, on 28.02.2025 in Crl.M.P.(MD)No.13799 of 2024, directed the petitioner to report before the Tiruppur South Police Station daily at 10.30 a.m. until further orders. Now, this petition has been filed to relax the said condition.

3. The learned counsel appearing for the petitioner submits that as per the order of this Court dated 28.02.2025, the petitioner is regularly complying with the condition from 14.03.2025. He further submits that the petitioner is now suffering with certain ailments and there is no one to look after his parents. Therefore, the petitioner seeks to modify the condition.

4. The learned Government Advocate (Crl. Side) appearing for the respondent Police submits that the petitioner is regularly complying with the condition from 14.03.2025.

5. Considering the fact that the petitioner is regularly complying with the condition from 14.03.2025, this Court is inclined to modify the condition imposed in Crl.M.P.(MD)No.13799 of 2024.

6. Accordingly, this petition is allowed and the condition is modified to the effect that the petitioner shall appear before the respondent Police once in a week, i.e. on every Monday at 10.30 a.m. until further orders. The petitioner and his sureties shall file an affidavit before the respondent Police that the petitioner will not disturb the victim at any point of time.
