and consequently to enlarge the petitioner on bail on the very same itself by disposing the petitioner's bail application. Side) O R D E R This petition has been filed to direct the learned IInd Additional District and Sessions Judge(PCR), Tirunelveli, to consider the bail application of the petitioner in connection with the FIR in Crime No.21 of 2023 on the file of the 2nd respondent police on the very same date of the surrender of the petitioner and consequently to enlarge the petitioner on bail on the very same itself by disposing the petitioner's bail application.

The petitioners are the accused persons in Crime No.21 of 2023 on the file of the 2nd respondent police for the offences punishable under Section 147, 148, 341, 294(b), 352, 427, 506(i), 436 of IPC r/w 3(1)(r), 3(1)(s), 3(2)(Va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 2015.

3. Mr.B.Nambiselvan, learned Additional Public Prosecutor, accepts notice for the respondents 1 and 2. He would further submitted that an earlier application was dismissed by this Court.

4. The earlier application was dismissed on the ground that the petitioner is facing 17 cases out of which most of cases are either under Mines and Minerals(Development and Regulation) Act, violation or under IPC. Now this petition has been filed without any change of circumstances. I find no reason to entertain this petition without any change of circumstances.

5. The learned counsel for the petitioner submitted that the petitioner's name is not mentioned in the FIR.

6. But however the conduct and bad antecedents of the petitioner was taken into account while dismissing the earlier petition. Since, no new grounds has been made, this Criminal Original Petition is dismissed. 24.04.2023 NCC : Yes / No Index : Yes/No Internet : Yes/No pnn 3/4
