Prayer: Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorarified Mandamus, to call for the entire records in connection with the impugned provisional Selection List of candidates dated 20.03.2015 for the post of Computer Instructors 2014 of the second respondent insofar as non-inclusion of the petitioner at Sl.No.502 and quash the same and consequently, direct the second respondent to include the name of the petitioner in the provisional selection list of candidates dated 20.03.2015 for the post of Computer Instructors 2014 as Sl.No.502-A. For Petitioner : Mr.R.Devaraj For R1 : Mr.D.Muruganantham, Additional Government Pleader.
For R2 : Mr.V.R.Shanmuganathan, Special Government Pleader.
ORDER
The provisional selection list of candidates dated 20.03.2015 for appointment to the post of Computer Instructors, is under challenge in the present Writ Petition. 2.The Writ Petition is filed, challenging the provisional list of candidates without even impleading the selected candidates. The selection list cannot be quashed without https://hcservices.ecourts.gov.in/hcservices/
providing an opportunity to the persons, who are all selected and placed in the selection list. Thus, the Writ Petition is liable to be rejected on the ground of not impleading the necessary parties.
3.This apart, the selection was of the year 2014 and the selected candidates were already appointed and serving in the post of Computer Instructors for the past about 5 1⁄2 years. Under these circumstances, the relief as such sought for in the present Writ Petition to quash the selection list, cannot be granted. The selection list impugned had already acted upon and the orders of appointments were issued and those candidates, who are selected and appointed, were not impleaded as party respondents in the present Writ Petition. Thus, if at all any grievance exists to the writ petitioner, it is left open to her to redress the grievances in the manner known to law.
4.With these observations, this Writ Petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
