Heard the learned Counsel for the petitioner and Mr.M.Lingadurai, learned Special Government Pleader appearing for respondents.

2.Though the petitioner seeks issuance of a Writ of Mandamus to consider the petitioner's representation for transfer of patta in the name of the petitioner and his family members in respect of S.No. 42/3A, it is brought to my notice that the petitioner's grand-father was not entitled to lands in S.No.42/3A and only S.No.42/10, was assigned to the petitioner's grandfather, that too subject to condition that house has to be constructed within a period of six [6] months. 3.However, on instructions from Ms.C.Rajeswari, the Village Administrative Officer who is present in Court today, learned Special Government Pleader submits that even if the petitioner puts up 2/5

construction today and satisfies the requirement of assignment condition, the petitioner's request would be favourably considered, if otherwise the petitioner is entitled to.

4.Considering the above, the Writ Petition is disposed of, directing the petitioner to make a fresh application for transfer of patta, after putting up construction in compliance of the assignment conditions in S.No.42/10.
