Prayer: Writ Petition is filed under Article 226 of the Constitution of India, in the nature of a writ of Mandamus to direct the respondents 1 to 3, to forthwith reinstate the Writ Petitioner as Village Assistant and post the petitioner at any one of non-sensitive post within the time stipulated by this Court in the light of dictum laid down by the Honourable Supreme Court in
the case of Ajay Kumar Choudhary Vs Union of India, reported in 2015 (7) SCC 291.

Heard both sides and perused the materials available on record.

The petitioner, who is working as Village Assistant was kept under suspension with effect from 31.05.2024 vide proceedings of the third respondent pursuant to the registration of criminal case against him in Crime No.11 of 2024. Thereafter, he submitted a representation to the third respondent on 23.01.2025 to revoke his suspension order and post him in non-sensitive post. The grievance of the petitioner is that the said representation was not considered and enquiry was not concluded even after completion of 11 months.
3. The learned Special Government Pleader for the respondents submits that the representation of the petitioner, dated 23.01.2025 would be considered in accordance with law within a time to be stipulated by this Court.
4. In view of the above factual position and after hearing both sides, in my considered view, it is appropriate and desirable to dispose of the writ petition at the admission stage with the consent of both sides without going into the merits of the case with a direction to the third respondent to consider the representation submitted by the petitioner on 23.01.2025 in terms of G.O.Ms.No.81 Human Resources Management (N) Department, dated 04.08.2022 and pass appropriate orders in accordance with law to meet the interest of justice.
5. Accordingly, this writ petition is disposed of with a direction to the third respondent to consider the representation, dated 23.01.2025 of the petitioner in terms of instructions issued by the State Government in G.O.Ms.No.81 Human Resources Management (N) Department, dated
04.08.2022 and pass appropriate orders within a period of three weeks from the date of receipt of a copy of this order. No costs.
