ORDER

The present writ petition has been filed to direct the respondents No. 1 to 3 to provide adequate police protection and permission for conducting Kabadi Competition on 17.04.2025 at 10.00 p.m., to till 18.04.2025 10.00 a.m., in Kalaiyarankam opposite open ground at Jameen Kodangipatti Village, in the eve of Tamil New Year Celebration by considering the petitioner representation dated 04.04.2025.

2. According to the petitioner, he is the member of the festival committee. On the eve of Tamil New Year Celebration, the villagers have decided to conduct Kabadi Competition on 17.04.2025 at 10.00 p.m., to till 18.04.2025 10.00 a.m., in Kalaiyarankam opposite open ground at Jameen Kodangipatti Village. In this regard, they have sent a representation to the respondents on 04.04.2025 and the same was 2/6

not considered. However, after filing of this petition, the respondent police have served a copy of rejection order stating that in the representation, the petitioner has not stated about the safety measures taken during the tournament and law and order problem would arise, since nearby villagers will also participate in the tournament. However, the petitioner is ready to comply with the conditions imposed by the respondent police.

3.The learned Additional Public Prosecutor appearing for the respondents would submit that they have received the representation of the petitioner to conduct Kabadi Tournament and the same was rejected vide order, dated 09.04.2025, since the petitioner fails to furnish the particulars about the safety measures taken during the tournament and there is a chance for law and order problem. Hence, this petition is liable to be quashed.

4.This Court had heard the learned counsels appearing on both sides and perused the materials available on record. 3/6

5.According to the petitioner, the representation of the petitioner to conduct Kabadi tournament was rejected by the respondent police. According to the respondents, the representation of the petitioner was rejected by the respondents on the ground that the petitioner has failed to mention about the safety measures taken during the tournament and law and order problem would arise due to participation of nearby villagers. However, the reason stated by the respondent police not acceptable as the same is not in accordance with law. The Kabadi Tournament is a Sports event, the respondent police ought to have granted permission by imposing necessary conditions and provide police protection to conduct the event.

6.In view of the above, this writ petition is allowed and the rejection order passed by the Sub Inspector of Police, Sankaralingapuram Police Station, Thoothukudi District, dated 09.04.2025 is hereby set aside and the respondents No. 1 to 3 are directed to grant permission for Kabadi tournament and provide adequate police protection to conduct Kabadi Competition on 17.04.2025 at 10.00 p.m., to till 18.04.2025 4/6

10.00 a.m., in Kalaiyarankam opposite open ground at Jameen Kodangipatti Village, by imposing necessary conditions.

7. With the above said directions, this writ petition stands disposed of.
