ORDER
This Criminal Original Petition is filed to quash the final report in STC.No.2150 of 2024 on the file of Judicial Magistrate Court-IV, Madurai, filed for the offence punishable under Section 323 of IPC.
2. During the course of arguments, when this Court expressed that the points raised by the learned counsel for the petitioner are factual in nature, the learned counsel for the petitioner sought permission to withdraw this petition and has made an endorsement to that effect. However, the learned counsel would submit that since the petitioner is aged about 62 years, his personal appearance before the Trial Court may be dispensed with. He would further submit that the dispute is between the brothers; that the case is pending from 2022; that two witnesses have already been examined by the trial Court; and that the learned Magistrate may be directed to conclude the trial within a stipulated time.
3. Considering the request made by the learned counsel for the petitioner, the personal appearance of the petitioner before the Trial Court is dispensed with on all hearing dates (provided he is represented by a lawyer) unless his appearance is required by the learned Magistrate 2/4
for the progress of the trial.
