ORDER : The Court Made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under Sections 342, 294(b), 307 and 506(ii) I.P.C and Section 3 of Tamil Nadu Public Property (Prevention of Damage & Loss) Act, in Crime No.320 of 2018, seeks anticipatory bail.
2.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.
3.It is seen that the petitioner is having one previous case. The petitioner had caused damage to the Auto, worth about Rs.2,000/. The petitioner is directed to meet the victim in person in the presence of the respondent police and hand over a sum of Rs.2000/- (Rupees two thousand only). The victim shall give a receipt therefor and the same shall be produced before the Jurisdictional Magistrate at the time of surrender.
4.Subject to this condition, this Court is inclined to grant anticipatory bail to the petitioner subject to certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Kovilpatti and on his executing a bond for a sum https://hcservices.ecourts.gov.in/hcservices/
of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
