Respondents PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the respondent No.2 to transfer the investigation relating to the case in Crime No.156 of 2019 on the file of the fourth respondent to anyone of the Deputy Superintendant of Police other than third respondent for complete the investigation in accordance with law within the time stipulated by this Court. O R D E R

This criminal original petition has been filed seeking a direction to direct the second respondent to transfer the investigation relating to the case in crime No.156 of 2019 on the file of the fourth respondent to any one of the Deputy Superintendant of Police competent to investigate the same. 2.Today, when the petition is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondents, on instructions, would submit that in the petition mentioned crime number for example Crime No.156 of 2019, the third respondent being the Investigation Officer completed the investigation on 01.09.2019 and submitted the case records to the Additional Public Prosecutor, Madurai District, for obtaining the opinion. According to him, so far the case records have not been received from the Additional Public Prosecutor.

Crl.O.P.[MD]No.9213 of 2020 3.The submission made by the learned Additional Public Prosecutor is recorded.

4.On considering the submission made by the learned Additional Public Prosecutor, no doubt it is not fair on the side of the respondents to get back the case records from the Additional Public Prosecutor for the past ten months. However, the third respondent is directed to file a final report within a period of two weeks from today and file a compliance report before this Court. 5.With the above direction, this Criminal Original Petition is disposed of.
