RESPONDENT/ RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to grant further time to comply with the order dated 18/06/2018 in Crl.M.P(MD).No.5780 of 2017 in Crl.O.P(MD).No.6246 of 2017 dated 25/05/2017.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.BALAMURUGAN, Advocate for the petitioners and of Mr.M.ASHOKAN, Government Advocate(Crl.side) on behalf of the Respondent, the court made the following order:- This Criminal Miscellaneous Petition has been filed praying to grant a further time to comply with the order dated 18.06.2018 in Crl.M.P(MD)No.5780 of 2017 in Crl.O.P.(MD).No.6246 of 2017, dated 25.05.2017.

2. The learned counsel for the petitioners is present today. The learned Government Advocate (Criminal side) for the first respondent is also present.

3. The impugned order in respect of modification and extension of time was passed on 18.06.2018 by this Court. 4.The learned counsel for the petitioners states that he could not appear while pronouncing the order on 18.06.2018, since he did not notice the date of pronouncement of order, due to inadvertent mistake. Further, due to overburden, he has failed to file copy application within the stipulated time.

5.Taking note of the submissions made by the learned counsel appearing for the petitioners and considering the reasons assigned in this application and also in the interest of justice, this Court is inclined to allow this application. Accordingly, this petition is allowed and the petitioners are directed to surrender and execute the Sureties Bonds as ordered before the concerned Court within a period of three days from the date of passing of this order, failing which the order passed in respect of modification stands revoked automatically, without any further reference to this Court. sd/- 17/07/2018 / TRUE COPY / Sub-Assistant Registrar (C.S.)
