For Respondent : Mr.M.Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.318 Of 2021 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 148, 294(b), 332, 353, 506(i) IPC in Crime No.318 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that on 23.06.2021, when the defacto complainant was in duty at Viruveedu check post, at about 14.30 hours, three persons were came in two wheeler in a rash and negligent manner under the influence of alcohol and dashed against the barricade and fell down. One person sustained injuries. The defacto complainant and SSI Seeralan helped them and enquired them. While they were enquiring, three persons came in two wheelers bearing registration no.TN 99 M 6402 and TN 29 AM 7815 and they had abused the defacto complainant by stating that the accident had happened only due to barricade placed by them and attacked them with stones and stick. As a result, the defacto complainant sustained injuries. Hence, the complaint.

CRL OP(MD)No.8558 of 2021 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

4.The learned Government Advocate(Crl.side) appearing for the respondent police opposed this petition on the ground that except this petitioner all other accused have been arrested. He also produced CD with regard to the alleged occurrence. This Court had viewed the said CD. It shows that the accused in this case had acted rudely, violently and threateningly against the Police, who were engaged in their official duty at check post, using stones, wooden log and branch of coconut tree. The defacto complainant and one SSI Seeralan were attacked by the accused in this case. Therefore, considering the seriousness of the offence alleged to have committed by the petitioner against the law enforcement officials, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed.
