PRAYER: Civil Revision Petition filed under Section 227 of Constitution of India to issue a direction directing the learned Principal Subordinate Judge, Tiruchirappalli to dispose the suit in H.M.O.P.NO.783 o 2013 within a stipulated time that may be fixed by this Court.

O R D E R

This revision has been filed seeking for a direction to the learned Principal Subordinate Judge, Trichirappalli to dispose of H.M.O.P.No.783 of 2013 within a stipulated time.

2. Heard the learned counsel appearing for the petitioner and perused the materials available on record.

3. Mr.S.C.Herold Singh, learned counsel for the petitioner would submit that the petitioner has filed the Original Petition against the respondent for divorce. The respondent filed her counter on 17.03.2015 and thereafter, trial in Original Petition had commenced on 15.02.2016. After examination of petitioner's side evidence, the case was posted for examination of respondent's side evidence on 01.04.2016.

4. The learned counsel would further submit that the respondent has been repeatedly taking time, but, so far, has not produced any witness. The learned counsel would further submit that the petitioner is working in abroad and he has to join his duty in the month of September and therefore, there is an urgency in disposal of Original Petition and the delay in disposal of the Original Petition causes prejudice to the interest of the petitioner.

5. Considering the above submission of the learned counsel for the petitioner,, the learned Principal Subordinate Judge, Tiruchirappalli is directed to dispose of H.M.O.P.No.783 o 2013 as expeditiously as possible preferably on or before 31.10.2016.

6. With the above direction, this Civil Revision Petition is disposed of. No costs.
