JUDGMENT

(Judgment of this Court was delivered by R.VIJAYAKUMAR, J.) The fourth respondent in the Writ Petition has filed the present Writ Appeal challenging the order of the Writ Court, in W.P.(MD)No. 30841 of 2024, dated 14.02.2025, wherein, the Writ Court has issued a direction to the appellant College to re-admit the student. 2.A perusal of the records reveal that the Writ Petitioner was admitted to B.Sc Nursing for the academic year 2021-2025. The Writ Petitioner was suspended from college from 21.08.2024 to 10.10.2023 for being involved in a quarrel with his classmates. The case of the Writ Petitioner is that he was forcibly asked to get a transfer certificate and hence, he filed a Writ Petition seeking re-admission to the course. 2/6

3.The Writ Court, after considering the submissions made on either side, has arrived at a finding that the student should be re-admitted to the College. Challenging the said order, the College Management has filed the present Writ Appeal.

4.According to the learned Counsel for the appellant, this is not the first incident, in which the Writ Petitioner had behaved in an indisciplined manner. Considering the fact that it is the third occasion, where, the Writ Petitioner having been involved in a quarrel with his classmates, the Writ Petitioner was subjected to an enquiry and in fact, the Writ Petitioner has voluntarily taken the transfer certificate from the management and he has also joined another College in Chennai. In such circumstances, the question of re-admitting the student would not arise. 5.The learned Counsel for the first respondent/Writ Petitioner submitted that based on the orders passed by the Writ Court, the Writ Petitioner has obtained transfer certificate from the College in Chennai and he now wants to get re-admission in the appellant College. 3/6

6.Heard learned Counsel on both sides and perused the materials available on record.

7.After going through the orders passed by the Writ Court, we are of the considered opinion that the Writ Court has rightly directed the management to re-admit the Writ Petitioner considering his academic career and future. Since the allegations relate to the picking up a quarrel with his classmates and no other serious allegations are made against the Writ Petitioner, we are not inclined to interfere with the order of the Writ Court and we find no merits in the Writ Appeal. Accordingly, the Writ Appeal is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
