Mr.M.Sakthikumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.29/2023 on the file of the respondent police. ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 406 and 420 of IPC in Crime No.29 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the accused persons created a Trust in the 1/3
name and style of Aadhava Trust and by inducing several innocent persons, had collected huge amount, as if, they will get employment for the post of Teacher in the Government school and thereafter, gave appointment orders through Trust and paid meagre salary of Rs.5,000/- and thereafter, they have not paid any amount to the defacto complainant. Hence, the case.
3.The learned counsel for the petitioner submits that the petitioner is also one among the investors and invested a sum of Rs.5 lakhs in the name of his wife, namely, Sarada Devi and she has been appointed as a Special Teacher on 21.07.2021 at Government Higher Secondary School, Gandhi Nagar, Kovilpatti and the petitioner is not at all connected with the alleged offence and he is also one among the victims cheated by the said Trust.
4.The learned Government Advocate (Crl. side) has objected for grant of anticipatory bail on the ground that the petitioner has collected amount from the various private school teachers and some of the amount has also been transferred through his account.
5.Considering the nature of offence and the fact that there are materials as against the petitioner to prove the money transaction, this Court is not inclined to grant anticipatory bail to the petitioner.

6.Accordingly, this petition is dismissed.
