ORDER

The petition is filed seeking a direction to the respondent to complete the investigation in Crime No.199 of 2016 dated 30.06.2016 within a time frame.

2. The case of the petitioner is that there was an accident on 29.06.2016 near the Ring Road, Viraganoor Bridge at Melur, Madurai, in which the husband of the petitioner died. Hence, a case in Crime No.199 of 2016 came to be registered for the offences punishable under Sections 279 and 304(A) of IPC. Even after lapse of five years, investigation is not completed and final report is also not filed.

3. The learned Additional Public Prosecutor would submit that it is a hit and run case and it was closed on 10.07.2017. But, RCS notice is not served to the petitioner and so, he seeks one month time to file final report and serve RCS notice to the petitioner.

4. Considering the submissions of the learned Additional Public Prosecutor, the respondent is directed to file final report before the concerned Court within a period of 15 days from the date of receipt of a copy of this order and on such filing of final report, https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.8550 of 2021 notice has to be served upon the petitioner. The petitioner is at liberty to workout her remedy before appropriate Forum through appropriate proceedings.

5. With the above directions, this Criminal Original Petition is disposed of.
