ORDER

Heard the learned counsel on either side.

2.The revision petitioner is the plaintiff in O.S No.169 of 2013 on the file of the Principal District Munsif Court at Nagercoil. It is a suit for damages. In the said suit, the revision petitioner filed I.A No.187 of 2014 calling upon the defendants to produce certain documents. The said I.A was dismissed by order dated 09.04.2014. Questioning the same, this civil revision petition has been filed.

3.The court below has rightly come to the conclusion that since the defendants have been arrayed in their individual capacities, the question of directing them to produce the documents in question will not arise. The order impugned in this civil revision petition is sustained. It is now submitted that the B.S.N.L, has been made as a party to the suit proceedings. Therefore, liberty is given to the plaintiff to file a fresh interlocutory application seeking relief against B.S.N.L. If such an application is filed, the same will be disposed of on merits and in accordance with law. https://hcservices.ecourts.gov.in/hcservices/

4.With this liberty, this civil revision petition is dismissed. No costs. Consequently, connected miscellaneous petition is also dismissed.
