This Criminal Original Petition has been filed to direct the learned Judicial Magistrate, Rajapalayam to dispose of the case in C.C.No. 108 of 2016 within the stipulated period. 2.According to the petitioner, the petitioner is the defacto complainant in this case. Based on his complaint, a case has been registered by the respondent police in Cr.No.381 of 2013 against the accused persons. Though the case has been registered in the year 2013, so far trial has not been commenced. Therefore, seeks for speedy disposal this petition has been filed.

3.The learned Government Advocate (Crl.Side) would submit that based on the complaint of the petitioner, a case has been registered in Cr.No.381 of 2013 for the offence punishable under Sections 406, 420 r/w 34 of IPC. After completion of investigation, they have filed the charge sheet before the concerned Court. The case is posted for trial after framing of charges. The respondent police is ready to produce the witnesses as directed by the trial Court and co-operate to complete the trial proceedings.

4.Considering the limited scope of the prayer sought for by the petitioner and also considering the long pendency of the case, this Court hereby direct the learned Judicial Magistrate, Rajapalayam to complete the trial proceedings in C.C.No.108 of 2016 as early as possible without giving long adjournments, beyond 1 week by giving top priority to this case and the progress of the trial has to be intimated to this Court on the first working day of every English calendar month till the disposal of the case.

5.With the above directions, this Criminal Original Petition stands disposed of.
