CRIME NO. 408 OF 2020. ... RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the condition imposed by this Hon'ble court in Crl.OP(MD). No. 8523 of 2020 dated 18.08.2020 to the effect that instead of each with two sureties it may be modify as "two common sureties". Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.M.PITCHAI MUTHU, Advocate for the petitioners and of MR.K.SUYAMBULINGA BHARATHI, Government Advocate(Criminal side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the condition imposed by this Court in Crl.O.P.(MD) No.8523 of 2020, dated 18.08.2020.

2. This Court, by an order dated 18.08.2020 in Crl.OP.(MD) No.8523 of 2020, granted anticipatory bail to the petitioners on condition that the petitioners shall execute a bond for a sum of Rs.50,000/-(Rupees Fifty Thousand Only) each with two sureties each for a like sum to the satisfaction of the respondent police or to the police officer, who intends to arrest or to the satisfaction of the learned Magistrate concerned.

3. The learned counsel appearing for the petitioners would submit that the petitioners are one family members and due to https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.4301 of 2020 pandemic situation they are not able to arrange 12 sureties and hence, seeking modification to the effect that instead of 'each with two sureties' shall be modified as "Two common sureties".

4. Heard the learned Government Advocate (criminal side) appearing for the respondent police.

5. Considering the facts and circumstances, the condition is modified on condition that the petitioners shall execute a bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with common surety for a like sum to the satisfaction of the respondent Police or to the Police Officer, who intends to arrest or to the satisfaction of the learned Magistrate.
