This Writ Petition has been filed praying for a Writ of Mandamus directing the respondent to consider the petitioner's passport Application File No.MD 1078389553515 dated 23.03.2015 and issue new passport with his correct date of birth as 10.05.1973 instead of 20.07.1968 and also with the correct place of birth as Thelichatchanallur, Ramanathapuram District, Tamil Nadu instead of Paramakudi.

ORDER

This Writ Petition has been filed praying for a Writ of Mandamus directing the respondent to consider the petitioner's passport Application File No.MD 1078389553515 dated 23.03.2015 and issue new passport with his correct date of birth as 10.05.1973 instead of 20.07.1968 and also with the correct place of birth as Thelichatchanallur, Ramanathapuram District, Tamil Nadu instead of Paramakudi.

2. Mr.G.R.Swaminathan, learned Assistant Solicitor General of India takes notice for the respondent.

3. By consent, this Writ Petition itself is taken up for final disposal.

4. The learned counsel appearing for the petitioner would submit that it would be suffice if the application of the petitioner is disposed of, on merits and in accordance with law within the time stipulated by this Court.

5. The learned counsel appearing for the respondent has no objection in considering the request of the petitioner.

6. In view of the above, without going into the merits of the claim made by the petitioner, the respondent is directed to pass appropriate orders on the Application File No.MD 1078389553515 dated 23.03.2015, on merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order. It is made clear that this order should not be construed as giving any positive direction to the respondent and he should pass orders depending upon the facts and circumstances of the case.

With the above direction, this Writ Petition stands disposed of. No costs.
