Prayer : Civil Revision Petition is filed under Article 227 of the Constitution of India, to set aside the order passed in unnumbered HMOP No. of 2016 dated 18.03.2016 on the file of the Family Court, Tirunelveli and direct the Family Court, Tirunelveli. For Petitioner : Mr.S.R.A.Ramachandran

ORDER

The petitioner herein filed HMOP before the Family Court, Tirunelveli for dissolving his marriage with the respondent herein. The court below declined to number the HMOP on the ground that the marriage invitation has not been enclosed.

2.I am of the view that on this ground the court below cannot decline to number the HMOP. Hence, the order impugned in this civil revision petition is set aside. The court below shall number the HMOP if it is otherwise in order. The Registry shall return the original HMOP filed by the petitioner herein to the counsel for the petitioner so that it can be re-presented before the court below. This civil revision petition is allowed. No costs.
