ORDER

The Civil Revision Petition invoking under Article 227 of the Constitution of India has been filed against the order dated 04.04.2022 in TR.O.P. No. 31 of 2020 passed by the District Court, Karur directing the suits in O.S. No. 582 of 2011, 162 of 2016, 211 of 2013 and 332 of 2014, on the file of the Additional District Munsif Court, Karur to be transferred to the District Court, Karur to try along with O.S.No. 29 of 2019 simultaneously or separately. 2.Heard Mr.K.Guhan, learned Counsel for the Petitioner, Mr.I.Velpradeep, learned Counsel for the Respondents 1 to 3, Mr.Pon Senthil Kumar, learned Counsel for Respondents 4, 5, 7 and 8 and Mr.F.Deepak, 2/6

Learned Special Government Pleader for Respondents 9 to 12. 3.The learned Counsel for the Petitioner has brought to notice that by an earlier order dated 31.07.2019 in C.R.P. (MD)No.958 of 2014, this Court had directed the Trial Court to frame preliminary issues with regard to the disputed status of the respondents as legal representatives of the deceased Balakrishnan before disposing the civil suits. The said order has attained finality as on date as it has not been challenged by any of the parties. 4.Though it has been sought to be projected before this Court that the parties are not same in all suits and the properties are not common, perusal of the materials placed on record reflects that the issue relates to the suit property in Survey No. 628 at Lakshminarayana Samuthram Village, Karur Taluk.

In particular, it is pointed out that four suits on the file of the Additional District Munsif Court, Karur are between the same parties and it is only in the District Court, the plaintiff happens to be a different person. Reading of the case in O.S. No. 29 of 2019 would go to show that the said original plaintiff claimed title to the property by way of the purchase from Barathan and Rajiv, who are the plaintiffs in the suits before the Additional District Munsif Court, Karur. In other words, he has stepped into their shoes.

that the parties are entirely different so as to try the suits separately. On the contrary, joint trial of the suits would ensure complete recording of evidences to decide the issue raised between the parties in an effective manner, to avoid multiplicity of proceedings and to meet the ends of justice. 5.Having regard to the fact that this Court has already given a direction for framing preliminary issue, the District Court, Karur shall decide the preliminary issue. Thereafter proceed further in the matter in accordance with law. Since the suits are of the year 2011, it shall be ensured that there is atleast two effective hearings every month showing progress of the case, and the Trial Court shall send monthly reports to the Registrar (Judicial) of this Court till the final order is passed.

6.In the result, the Civil Revision Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. No costs. 20.01.2026 Index : Yes/No NCC : Yes/No cmr 4/6
