O R D E R

The Writ Petition has been filed in the nature of a Mandamus seeking a direction against the first respondent to consider the representation of the petitioner given by the petitioner, dated 22.03.2023. 2.Heard Mr.M.Viajarajan, learned Counsel for the petitioner and Mr.N.Muthu Vijayan, learned Special Government Pleader for the respondents.

3.In the affidavit filed in support of this Writ Petition, it had been stated that the petitioner is working as a Sweeper in Paramakudi Government Hospital. Her elder brother, Sonai Karuppan, was a Cultural Artist. His wife died earlier. They have one daughter, Srivani, aged about 12 years. It had been stated that the brother of the petitioner, when 2/5

he was riding his two wheeler, TN-65-AZ-7138, at Vallakulam Village near Abiramam, on 22.02.2020 at around 05.30 am, he met with an accident by falling into a pit which had been dug up by the Public Works Department. He suffered severe injuries and was taken to the hospital and was declared brought dead. The petitioner had sought solatium under the Chief Minister's Accidents Relief Fund. 4.The learned Special Government Pleader had forwarded instructions given by the Sub Collector, Paramakudi, wherein, it had been stated that the petitioner's claim for compensation is in Serial Number 292 for grant of adequate compensation and it had been stated that when funds are sanctioned under the Chief Minister's Accidents Relief Fund, the petitioner would be granted necessary compensation. 5.

A Mandamus is issued that the third respondent immediately when funds are sanctioned under the Chief Minister's Accidents Relief Fund for Ramanathapuram District, may issue notice to the petitioner and pay necessary solatium to the petitioner consequent to the death of her brother, who has left behind a young daughter aged 12 years.

6.The Writ Petition stands disposed of with the above directions. No costs.
