Respondent PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the first respondent to receive the petitioner's application dated 06.05.2022 along with fee for the stoppage of the Spare Bus bearing Registration No.TN 45 AF 6777 and forward the same to the second respondent to inspect the Spare Bus Garaged at Star Rice Mill, Opposite Nariyankadu, Thiruchitrampalam, Pattukkottai, Thanjavur District and issue the stoppage report to the period from 01.01.2021 to 30.04.2022. ORDER

The present writ petition has been filed seeking a mandamus directing the respondents to receive the petitioner's application along with fee for the stoppage of spare bus bearing Registration No.TN 45 AF 6777 as per the Motor Vehicle Rules.

2. According to the writ petitioner the respondent is refusing to receive her application for the reasons best known to him.

3. The learned counsel for the respondents pointing out the Tamil Nadu Motor Vehicle Rules 172(6) Proviso submitted that exceeding a period of 20 days, the RTO has no power to receive the said application and the petitioner has to approach only the RTA, who is the District Collector. Hence, the Writ Petitioner is directed to approach the RTA. 4. With the above direction, this Writ Petition stands disposed of. No costs.
