Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents 2 and 3 to dispose of the petitioner's transfer appeal before this 2nd respondent, Na.Ka.No.A4/2669/2021, within a time frame and keep the patta in the erstwhile status in the name of Periyakarupan, with Patta No.1052 with the

whole extent of 2.58 acres with S.No. 562/1, which was standing in the petitioner's father Periyakaruppan`s name in T.Meenachipuram Village For Petitioner :

ORDER

The Writ Petition is filed, seeking a direction to respondents 2 and 3 to dispose of the petitioner's transfer appeal pending on the file of second respondent in Na.Ka.No.A4/2669/2021 within the time stipulated by this Court.

2. According to the petitioner, the subject property is his ancestral property and a civil litigation is pending in respect of the said property in S.A. (MD) No.89 of 2022. The petitioner submitted an application before the official respondents, seeking transfer of patta from the name of petitioner's father to his name, but the same has not been considered. However, the third respondent subdivided the property into two parts, by giving new sub-division Nos.562/1A and 562/1B. Aggrieved by the same, the petitioner submitted an appeal before the second respondent and the same was taken on file in Na.Ka.No.A4/2669/2021. However, the same is not yet disposed. Therefore,

the petitioner has come before this Court, seeking a direction to the second respondent to dispose of the said appeal.

3. The Additional Government Pleader, appearing for the respondents, would submit that the appeal filed by the petitioner and pending on the file of the second respondent will be disposed of in accordance with law.

4. In view of the same, without expressing any opinion on the merits of the matter, the second respondent is directed to dispose of the appeal pending on his file in Na.Ka.No.A4/2669/2021 within a period of twelve weeks from the date of receipt of copy of this order, after issuing notice to petitioner and other interested parties.

5. Accordingly, the Writ Petition stands disposed of. No costs. Consequently, the connected W.M.P.(MD) No.8361 of 2023 is closed. 15.07.2025 NCC :
